Firm Defeats RICO Claim Brought Against Law Firm on Summary Judgment

January 19, 2018: Partners Robert Klein, Richard Jones, and associate Andrew Feldman obtained final summary judgment on behalf of a law firm that was accused of engaging in a RICO conspiracy to funnel assets into a charitable organization through a scheme to forge estate planning documents.  In ordering the claim dismissed, the Court concluded there was no genuine issue of material fact to overcome the presumption that the estate planning documents at issue were valid and held that the Plaintiff had no viable damage theory.

The case is: Ellis v. Warner, 15-10134-CIV, 2018 WL 4846762 (S.D. Fla. Jan. 19, 2018).
